a) the right of access

What you need to know:

  • it is possible to ask for a commission, based on administrative costs, if you require more than one co-operation;

  • you have the right to obtain incomplete personal data;

You have the right to obtain from the Operator the deletion of personal data concerning your country, justified delays, under certain conditions:

  • will withdraw consent if the processing is based on consent or the processing concerns the special personal data, is based on consent and there is no other legal basis for the processing;

  • will oppose the processing required to perform a task that is in the public interest or resulting from the exercise of the authority with which the Operator was invested or the processing is based on a legitimate interest of the Operator or a third party and there are no legitimate reasons to prevail processing or you will oppose direct processing of direct marketing, including the creation of profiles related to direct marketing;

  • personal data has been processed illegally;

  • personal data must be deleted for compliance with a legal obligation on the Operator, unless processing is required:

  • for the exercise of the right to freedom of expression and information;

  • to comply with a legal obligation;

  • for purposes of archiving in the public interest, for scientific purposes or for historical studies or for statistical purposes;

  • to establish, exercise or defend a right in court.

c) the right to restrict the processing

What you need to know:

You have the right to obtain from us restrictions on processing under certain conditions:

  • if you exercise your right of objection while we are reviewing the accuracy of your personal data;

  • if the processing is illegal, and you will oppose the deletion of your personal data and request that you restrict the use thereof;

  • during the period when we verify that our legitimate rights prevail over yours, in the situation when you opposed your processing for reasons related to your particular situation;

  • we no longer need personal data, and you ask for it to be ascertained, exercised or defended in court.

Please be assured that we will inform you before the lifting of the processing restriction for the 4 above mentioned situations.

Important to remember:

  • if the restriction of processing took place in the 4 situations mentioned above, processing may take place, except for storage, only on the basis of your prior consent for the establishment, exercise, defense of a right in court or for the protection of the rights of another natural or legal person in reasons of major public interest of the EU or of a Member State.

d) the right to portability of personal data

What you need to know:

  • you have the right to obtain from us, in a structured, currently used and automatically readable form, the personal data that concern you and which you have provided to us, and you also have the right to request the transmission these data to another operator;

  • the exercise of the above two rights may take place if the following conditions are met cumulatively: (i) our processing is based on your consent and has as its object also special special dates or processing is necessary for the performance of a contract to which you You are a party to, or take steps to, your request prior to the conclusion of a contract; (ii) processing of personal data is done by us by automatic means; (iii) the exercise of the right to data portability is without prejudice to the right to delete data and does not affect the rights and freedoms of others.

e) the right to object

What you need to know:

  • you may oppose at any time processing is required to perform a task of public interest or resulting from the authority with which we have been invested, including the creation of profiles on such grounds (ii) for our legitimate interest, or tert.   • in the cases mentioned in subp. (i) and (iii) above, you will have the right to obtain human intervention on our part express your point of view and challenge the decision.

i) the right to address the law

Important issues regarding your rights

  • the deadline for responding to your requests: the standard term is one month from the date of receipt of the landing. If the response requires a high complexity analysis (eg large volume of documents / information, etc.), this deadline can be extended by two months, meaning we will inform you about this in the initial one month period.

  • Restriction of access: In certain circumstances, we may not be able to grant you access to all or part of your personal data in the light of the existence of restrictions imposed by law. The reason for the refusal in this situation will be communicated to you.

We will not be subject to the decision-making process automatically, including profiling.

We do not use automated decisions.

SC INDECO SOFT SRL processes your personal data as an operator, respectively the image by automated means, in order to monitor the access of persons and ensure their security and the premises and assets of the operator according to the provisions of Law no. 190/2018 on measures to implement Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing of Directive 95/46 / EC (General Data Protection Regulation).

Personal data are recorded and stored on the SC INDECO SOFT SRL servers. Access to images is done by the IT security officer only if an incident occurs.

Video recording is stored for 30 days.

Deleting this videos is done automatically when the 30-day expires, but if the IT security officer is notified of a removal request, it will handle the request as soon as possible and without undue delay.

According to Law no.677/2001, and the GDPR person concerned shall enjoy the following rights:

  • the right to information: is the fact that the data subject has the right to obtain from SC INDECO SOFT SRL a confirmation whether or not video recordings are being processed

  • the right of access: the data subject has the right to obtain from SC INDECOSOFT SRL a confirmation that video records are being processed and, if so, access to those data. The registration, processing and response to the person concerned are free of charge.

  • the right to delete the data: means that the data subject is entitled to request SC INDECO SOFT SRL to delete the data collected without undue delay in any of the following situations: no longer required for the purposes for which they were collected, the person opposes the processing,

  • the data were collected illegally, the data must be deleted for compliance with a legal obligation, the collection was done with the provision of information society services.

Also, the registration, processing and settlement of the request will be made free of charge.

  • the right to data portability: the data subject has the right to receive the video data of his or hers in a structured format that is currently used and can be read automatically and has the right to transmit this data to another operator without any obstacle from the operator to whom the personal data were provided;

  • the right not to be subject to an automatic decision with significant effect: the data subject has the right not to be the subject of a decision solely based on automatic processing, including the creation of profiles, which produces legal effects affecting the data subject or affects it in a similar way to a significant extent; and the right to appeal to justice.

If the data subject is of the opinion that SC INDECO SOFT SRL has violated any of his rights in this matter, he may address the National Supervisory Authority for Personal Data Processing.

Video recordings will not be transferred to other states or third parties.

Security incidents: – At the written request of the injured person, the records may be submitted to the competent investigation bodies.

In the event that SC INDECO SOFT SRL is the injured person, the video recordings will be accessed by the IT security officer. It will send the video sequence of the incident to the Chief Executive Officer and Administrator to initiate the necessary procedures.
